1. Acceptance of Terms

By accessing and using the MailShield platform (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

MailShield reserves the right to change these terms at any time. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. It is your responsibility to review these Terms periodically for changes.

2. Service Description

MailShield is a cloud-based email security platform that provides DMARC (Domain-based Message Authentication, Reporting, and Conformance) monitoring, DNS (Domain Name System) analysis, email authentication reporting, and related security intelligence services.

The Service includes:

  • DMARC report aggregation, parsing, and analysis
  • Email spoofing and phishing threat detection
  • DNS record monitoring and health checks
  • Email authentication status tracking (SPF, DKIM, DMARC)
  • Security alerts and notifications
  • Historical reporting and analytics
  • API access for integration and automation

Features and functionality vary by subscription plan. MailShield makes no warranty regarding the completeness or accuracy of any third-party data or reports provided through the Service.

3. Eligibility and Account Responsibility

You represent and warrant that you are at least 18 years of age and have the right and authority to enter into this agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify MailShield immediately of any unauthorized use of your account.

You are solely responsible for:

  • Keeping your password and authentication credentials secure
  • All activities conducted through your account
  • Ensuring that the domains you monitor are owned or authorized for monitoring by you
  • Compliance with all applicable laws and regulations in your jurisdiction
  • Accurate and truthful information provided during registration

MailShield reserves the right to suspend or terminate your account if we believe you have violated these terms or pose a security risk.

4. Acceptable Use Policy

You agree not to use the Service for any unlawful purpose or in violation of any applicable laws or regulations. Specifically, you agree not to:

  • Monitor domains you do not own or have no authorization to monitor
  • Use the Service to harass, threaten, abuse, or defame any person
  • Attempt to gain unauthorized access to the Service or related systems
  • Reverse engineer, decompile, or disassemble the Service
  • Engage in any form of automated scraping or data harvesting without authorization
  • Transmit viruses, malware, or any other harmful code
  • Overload or interrupt the normal operation of the Service
  • Use the Service in any manner that could damage or impair our infrastructure
  • Resell or redistribute the Service without written permission

5. Subscription and Payment Terms

Billing

MailShield operates on a subscription-based model. Pricing and features are specified for each plan. Billing occurs automatically on a monthly or annual basis, depending on your selected plan.

Payment Methods

All payments are processed through Stripe or other authorized payment processors. By providing payment information, you authorize MailShield to charge your account on a recurring basis.

Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings.

Failed Payments

If a payment fails, we will attempt to contact you. If payment is not received, your account may be suspended or terminated.

Refunds

Refunds are not offered for partially used subscription periods. All sales are final. If you believe a charge was made in error, contact us within 30 days of the charge.

Price Changes

MailShield reserves the right to change prices at any time. Price changes will be communicated at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. Data Collection and Usage

Data Collected

To provide the Service, MailShield collects and processes the following types of data:

  • Email metadata (sender, recipient, domain, authentication status)
  • DMARC aggregate reports sent by email receivers
  • DNS records (SPF, DKIM, DMARC, MX, TXT, CNAME records)
  • IP addresses of sending sources
  • Account information (name, email, company name, domain names)
  • Usage data and analytics
  • Payment and billing information

How Data Is Used

We use the collected data to:

  • Provide, maintain, and improve the Service
  • Detect and prevent security threats and fraud
  • Generate reports and insights
  • Communicate with you about your account and the Service
  • Comply with legal obligations
  • Analyze trends and usage patterns (in anonymized form)

Email Message Content

MailShield does not read, store, or analyze the full content of email messages. We only process email metadata and DMARC report data as necessary to provide the Service.

7. Intellectual Property Rights

The Service, including all content, software, documentation, and materials, is owned by or licensed to T&C Technologies LTD. All intellectual property rights in the Service are reserved.

You retain all intellectual property rights in any data you submit to the Service. However, you grant MailShield a worldwide, royalty-free license to use, display, and analyze your data as necessary to provide the Service, including for the purpose of improving our threat detection and analytics capabilities.

You may not reproduce, distribute, modify, or create derivative works of the Service without prior written consent from MailShield.

8. Data Security and Storage

MailShield implements industry-standard security measures to protect your data, including encryption in transit (TLS/SSL) and at rest. However, no system is completely secure, and we cannot guarantee absolute security.

Your data is stored on secure servers hosted on cloud infrastructure (AWS or similar providers). Regular backups are maintained to protect against data loss. We do not share your domain monitoring data with third parties except as required by law or as disclosed in our Privacy Policy.

You are responsible for maintaining regular backups of any data you consider critical. MailShield is not liable for data loss resulting from your failure to maintain backups.

9. Third-Party Services and Integrations

The Service may integrate with third-party services, including:

  • Stripe — for payment processing
  • Google OAuth — for authentication
  • Email Service Providers — for sending notifications and reports
  • Cloud Providers — for infrastructure and hosting

Use of these third-party services is subject to their respective terms and privacy policies. MailShield is not responsible for the performance, security, or policies of third-party services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAILSHIELD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF PROFIT, LOSS OF BUSINESS, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL LIABILITY OF MAILSHIELD FOR ANY CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAILSHIELD DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MailShield does not warrant that:

  • The Service will be uninterrupted or error-free
  • Any defects in the Service will be corrected
  • The Service will detect all threats or unauthorized email activity
  • DMARC or DNS data will be 100% accurate or complete
  • Any third-party data integrated into the Service is accurate

12. Service Availability and Maintenance

While we strive for high availability, MailShield does not guarantee 100% uptime. We may suspend or limit access to the Service for maintenance, updates, or security reasons. We will attempt to provide advance notice of scheduled maintenance.

MailShield is not responsible for any disruption of service caused by circumstances beyond our reasonable control, including but not limited to internet outages, natural disasters, or third-party service failures.

13. Termination

Termination by You

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your access to the Service will be revoked, but you remain responsible for any outstanding charges.

Termination by MailShield

MailShield reserves the right to terminate or suspend your account without notice if:

  • You violate these Terms of Service
  • You engage in illegal activity or fraud
  • You pose a security risk to our infrastructure
  • You abuse the Service or harass our staff

Effect of Termination

Upon termination, your access to the Service will cease, and we may delete your account data after a reasonable period (typically 30 days). No refunds will be issued for terminated accounts.

14. Indemnification

You agree to indemnify, defend, and hold harmless MailShield, T&C Technologies LTD, and their officers, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your infringement of any intellectual property rights
  • Your monitoring of domains without authorization

15. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand our data handling practices, your rights, and how we protect your information.

If you are located in the European Union or other jurisdictions with data protection laws, you have specific rights regarding your personal data, as detailed in our Privacy Policy.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Israel, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Israel.

Before pursuing legal action, you agree to attempt to resolve any dispute through good faith negotiation with MailShield at hello@mailshield.io.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MailShield regarding the Service and supersede all prior agreements and understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
